Mounties Charge Six in Bankruptcy Fraud Investigation Steve Webster July 12, 2013 AC Archives 1595 The RCMP’s Hamilton Niagara Regional Detachment Financial Crime Section has charged six people with offences under the Bankruptcy and Insolvency Act. The allegations all relate to an investigation into fraud and the abuse of the bankruptcy process. Ervin BENDIG, age 50, of Hamilton, Ontario has been charged with one count under the BIA, Section 198(1)(c)- ‘Make a material omission in a statement’ and thirteen counts under the BIA,Section 198(1)(e)- ‘Unlawfully after or within one year immediately preceding the date of bankruptcy event obtained credit’ Jan GODLA Jr., age 30, of Stoney Creek, Ontario has been charged with one count under the BIA, Section 198(1)(c)- ‘Make a material omission in a statement’, two counts under the BIA, Section 198(1)(e)- ‘Unlawfully after or within one year immediately preceding the date of bankruptcy event obtained credit’ and five counts under the BIA, Section 198(1)(a)- ‘Unlawfully make any fraudulent disposition of the bankrupt’s property’ Dana BENDIGOVA, age 29, of Hamilton, Ontario has been charged with one count under the BIA, Section 198(1)(c)- ‘Make a material omission in a statement’, four counts under the BIA, Section 198(1)(e)- ‘Unlawfully after or within one year immediately preceding the date of bankruptcy event obtained credit’ and ten counts under the BIA, Section 198(1)(a)- ‘Unlawfully make any fraudulent disposition of the bankrupt’s property’ Danka BENDIGOVA, age 48, of Hamilton, Ontario has been charged with one count under the BIA, Section 198(1)(c)- ‘Make a material omission in a statement’ and eight counts under the BIA, Section 198(1)(e)- ‘Unlawfully after or within one year immediately preceding the date of bankruptcy event obtained credit;’ Marie RAKASOVA, age 51, of Hamilton, Ontario has been charged with one count under the BIA, Section 198(1)(c)- ‘Make a material omission in a statement’ and eight counts under the BIA, Section 198(1)(e)- ‘Unlawfully after or within one year immediately preceding the date of bankruptcy event obtained credit’ and Jan GODLA Sr., age 53, of Hamilton, Ontario has been charged with one count under the BIA, Section 198(1)(b)- ‘Unlawfully refuse or answer fully and truthfully all proper questions put to him’ and eight counts under the BIA, Section 198(1)(e)- ‘Unlawfully after or within one year immediately preceding the date of bankruptcy event obtained credit’.
